ЗРАЗОК ЗВЕРНЕННЯ до МВФ Шановні вкладники банку «Фінансова Ініціатива», НБУ, Прокуратура, Антимонопольний комітет, СБУ, МВС, Президент, не реагують на наші звернення. Оскільки державному апарату повністю закрили очі на правопорушення, нам необхідно вимагати відповідної реакції міжнародних інституцій за рахунок яких, зараз формується держбюджет та видаються рефінансування банкам в тому числі ФІ. Нище, надаю зразок звернення в МВФ, місія якого зараз перебуває в Києві, з прохання адекватно проаналізувати та відреагувати на ситуацію, яка склалася між НБУ, вкладниками та ФІ. При бажанні, звернення можна відкоригувати … Прохання до кожного відіслати дане звернення через email, - і чим більшою кількістю вкладників (кількість звернень має бути більше 100). Прохання не полінуватися і заповнити всі відповідні форми (емаіли одержувачів, і тд). Я впевнений, в результаті численних звернення до МВФ місія якого вивчає, куди пішли кошти позик які він видав раніше, він проведе відповідні консультації з НБУ, і наше питання буде ОПЕРАТИВНО дуже ефективно вирішено))) ЗРАЗОК Subject: Letter to IMF re. Potential Consequences in Banking Stability of Ukraine Due to Illegal Position of the Bank «FINANSOVA INITSIATYVA» through inaction of the NBU Email: RR-UKR@imf.org, cee-office@imf.org, publicaffairs@imf.org, wfonteyne@imf.org, December 12, 2014 Mr. Jerome Vacher Resident Representative for Ukraine of International Monetary Fund (IMF) 5 Klovsky Uzvis 01021 Kyiv, Ukraine On behalf of depositors and customers of the Bank «FINANSOVA INITSIATYVA» Re: Potential consequences in banking stability of Ukraine due to illegal position of the Bank «FINANSOVA INITSIATYVA» through inaction of the National Bank of Ukraine Dear Mr. Jerome Vacher, We, depositors and customers of the PJSC Commercial Bank «FINANSOVA INITSIATYVA» (7/9 Schorsa Str., Kyiv, 03150 Ukraine,+38(044)5936071, info@the-bank.com.ua) hereinafter “the Bank”, are writing to you with an urgent request for your attention with respect to a situation that is evidently of critical importance to us, but which also may have serious ramifications for the success of the IMF program supporting economic reform in Ukraine, as announced on 30 April 2014, in which one of the key areas identified was that of banking stability. You are no doubt aware of some aspects of the present situation involving the Bank «FINANSOVA INITSIATYVA», a major bank within the nation's banking system—one of the largest in second group of banks (eighteenth place) in Ukraine in terms of deposits, involving more than 100,000 individuals. The Bank «FINANSOVA INITSIATYVA» is controlled by Mr.Oleg Bakhmatyuk, a Ukrainian oligarch who controls Ukraine’s largest farming and egg business (Avangardco IPL, Ukrlandfarming PLC, VAB Bank, etc). JSC Commercial Bank “FINANSOVA INITSIATYVA” is a Ukrainian bank which is a related party of the AVANGARDCO IPL, controlled by the ultimate shareholder, Mr. Oleh Bakhmatiuk. Many of the group companies are the bank’s customers. As of 30 June 2010, the group’s companies had entered into facility agreements with PJSC “Commercial Bank “FINANSOVA INITSIATYVA” in the total amount of U.S.$186,380 thousand and deposit agreements in the total amount of U.S.$197,222 thousand. AVANGARDCO, and the Bank “FINANSOVA INITSIATYVA” (a financial institution which has extended loans to, and taken deposits from, AVANGARDCO) are the Group’s most significant related parties. The company's cash is mainly deposited at Bank “FINANSOVA INITSIATYVA”. The Chairwoman of the Board of AVANGARDCO Mrs. Nataliya Vasylyuk, at the same time since 2013, has served as the Chairwoman of the Supervisory Board of PJSC Commercial Bank “FINANSOVA INITSIATYVA”. Previously Fitch acknowledged the efforts made by management to unwind most related-party transactions, in particular with the Bank “FINANSOVA INITSIATYVA”. Since April 2014 the Bank started it illegal actions re. non-returning of funds from deposit accounts. The Bank violates its obligations according to the contracts with depositors, but according to our applications to National Bank of Ukraine was not declared insolvent and a temporary administration was not appointed. Through inaction the National Bank of Ukraine violates legislation of Ukraine in the area of bank control and undermines the confidence to all bank system in our country. Over the next four months at numerous meetings with the National Bank and management of the Bank «FINANSOVA INITSIATYVA», we (the physical persons) were given promises by the head of the National Bank, and the Vice-Chairman of the Bank Mr. Andriy Demchenko regarding a favourable solution to the problem of preserving our deposits in full and allowing us to dispose them. For this purpose the National Bank of Ukraine refinanced the Bank «FINANSOVA INITSIATYVA» on amount around 9 000 000 000 hryvnias. However, the Bank is still not returning funds to depositors. For reasons not known to us, the National Bank of Ukraine is not reacting on this issue and rejected the proposal made by us to persuade Mr. Bakhmatyuk, the owner of the bank, to recapitalize the bank, and made the decision to announce the a temporary administration in other case. However, for reasons which are not clear, the NBU has not declared the Bank insolvent and a temporary administration was not appointed. The National Bank of Ukraine has not been able to provide a comprehensible answer to us as to why the Bank is not returning funds to depositors and why the owner of the bank Mr. Oleg Bakhmatyuk is not persuading to recapitalize the bank. At the same time, the Bank's balance sheet as of 01.07.2014 shows that its all assets (amounting to 18,1 billion hryvnias) are sufficient to cover the deposits of all individuals without exception, as well as all outstanding debts to the legal entities and to the National Bank, which provided support for the refinancing of the Bank. Currently, the depositors and customers are suing the Bank for the illegality of it’s actions (please see below extracts from Court Decisions Registry of Ukraine): To date, the situation with respect to the bank continues to be extremely non-transparent and politicized, the recapitalisation of the bank has not been started, and we, the bank's depositors, have become victims of someone's political ambitions and the interests of corruption. At stake is not only our future as physical persons and that of our families, but also the future of the legal persons, i.e. the business enterprises that provide work for thousands of people all over Ukraine. THE MOST TRAGIC THING FOR ALL UKRAINIANS IS THE FACT THAT DUE TO SUCH ACTIONS OF THE BANK’S MANAGEMENT AND THE NBU THE TRUSTWORTHINESS OF THE COUNTRY'S ENTIRE BANKING AND FINANCIAL SYSTEM IS NOW IN QUESTION. It is quite obvious that the liquidation of such a major bank may cause a domino effect within the banking system which will undermine the trust of the general public in their banks and will lead to a further outflow of deposits and the subsequent destruction of Ukraine's banking sector. This will totally undercut the extremely valuable initiatives of the IMF to promote banking stability here, and could have a serious impact on the willingness of foreign governments to make additional contributions toward this greatly desirable goal. More than eight months we are not able to use our funds on banks accounts. We understand that management of the Bank «FINANSOVA INITSIATYVA» is responsible for this problem. We are very disappointed about current situation. But we still hope you have some influence on the Bank «FINANSOVA INITSIATYVA» through the National Bank of Ukraine and you will be able to resolve this issue. Please note: National Bank of Ukraine doesn't pay any attention to this problem and just recommending to protect our rights in court. That's why we asking you to apply any possible measures which will help us to resolve problem which may cause instability effect within the whole banking system of Ukraine.
